Dear Seniors & Friends,
As the news regarding the suspension of leading orthopedic surgeon (30 years in practice) of KEM hospital Mumbai by Medical Council of India for practicing with a lapsed license has surfaced, the issue of legal importance of Medical council Registrations has come into the limelight. The said orthopedic surgeon, against whom, a complaint was filed with the council in an alleged medical negligence case, while being exonerated by the Council on the negligence charges, was held guilty on account of practicing without a license
Please bear in mind the following facts :
● Medical Council Registrations are not only required for Private Practice, but also for those in Govt Jobs.
● Health is a state subject, so every doctor practicing in any state of the country has to register with that state medical council in order to practice in that particular state/UT.
● All additional qualifications, (Post MBBS) should be updated with the respective state medical council, Only after that updating, a medical practitioner is allowed to practice (legally) the specialty of the additional qualification. If one has registered his MBBS degree qualification with state medical Council, and has not registered his additional qualifications, ie.MD / MS or DM / MCH, then please do Register your additional qualifications (MD/ MS etc) with the state medical council. Please keep in mind that even if your additional qualifications are registered with MCI or another state's medical council, you still have register these additional qualifications with your present state medical council (seems quite unnecessary, but unfortunately that’s what the law says !!).
● *If some one is visiting another state for practice, he has to also register with that state's medical council*. One state medical council registration only allows to practice within the boundary of that state. In order to practice in another area (outside state), one requires obtaining valid registration with the new state medical council.
● *Similarly the doctors visiting from others states for Medical Practice / OPDs/ Medical procedures in your state have to also register with the state Medical Council.*
