(iii) to ensureeffective irnplementationof minimum standardsof care in Centresas laid down by the Governrnentof India or any StatutoryBody or this Committee;

(iv) to help and guide for establisha collaborative treatment network among the centres and Govermental and Non- GovernmentalHealth Care facilities;

(v) to conduct facilitating training prograrnrne for personnel deployedin centresi

(vi) to undertakeany other activity for the promction of welfare and rehabilitation of addicts;

(vii) to decide the appeaisagainst the decisions of the licensing authority”

4. A personshatlbedisqualifiedfor beingappoirrtedasarnembercrrin Disqaliiicatron. caseis already appointed then shall be rernoved by the Gcvernment if he,

(i) hasbeenconvictedandsentencedto imprisonmentfor anoffence which in the opinion of the Governmentinvoives moral turpitude; or

(ii) is an undischargedinsolvent, or

(iii) is af unsoundmined and standsso declaredby a cornpetentcourt” of,

(iv) has been removed or dismissedfrom the Government or a body corporateowned or controlled by the Government.

5. (1) Every non-official rnember shall hold office for a period of three Term of oflice of

years from the date of his appointment and shall be eligibie for re-appointment.

(2) Anon-officialmembermayatanytimeresignfrommernbershipof the Authority State Level Committee by forwarding letter of resignation to the Chairmanandsuchresignationshalltakeeffectfrom thedateoa which it is accepted.

(3) Whereavacancyoccursbyresignationorotherwiseofanon-official metnber, the Government shall fill the vacancy by appointing from amongst the samepersonsandthepersonssoappointed,shallholdoffice for theremainderof the term of office of the member in whose place he has been so appointed.

(4) Where the term of office of any non-official member is about to e x p i r e , t h e G o v e r n m e n t m a y a p p o i n t a s u c c e s s o rt h r e e m o n t h s b e f o r e t h e e x p i r y o f the term of such memberbut the successorshall assumeoffice only after expiry of the term of the member.

6. (1) ThereshallbeaStateLevelLicensingAuthorityconsistingofthe following members;namely:-

(2) ThefunctionsoftheLicensingAuthorityshallbeasunder:-

(i) to issue provisional licence, regular licence and to renew

licence for operation of centres set up by any organization ; and to registercentresalreadyoperating;

(ii) to investigate complaints against centres as also against suspected/allegedunlicensed centres;

(iii) to monitor, superviseand evaluatefunctioning of various cenfresin the Stateof Haryana;

(iv) to ensureminirnum standardsof care in the centre basedon

(v) toimplementand_monitortheguidelinespreparedbyState Level comrnittee for settingup andfunctioning of thecentres;

(vi) to caffy out periodic inspectionsof the centresand in caseof any violations initiating punitive proceedingsincluding suspensionor cancellationof the licence;

(i) onreceiptof anapplication,informtr-thel-icensingAuthority may causesuch enquiries to be rnadeabout the applicant as it deemsfit to ensurethat the applicant is capableof adhering to the minimum stand.ardsprescribed under these rules for

(i0 after getting suitable enquiry conducted and after satisfying ibelf about the capabilities of an applicant for setting up a centre in accordancewith the minimum standardsprescribed in theserules,the licensingauthority shall issuea provisional licenceto the;

(iii) after issuanceof provisional licence, the applicant shall comply with theprescribedminimum standardsandsuchother conditions as are prescribed by the licencing authority, and requestthe Licensing Authority to grant regular licence within a period of six months. If he fails to apply for the regular licence within the specified period, he shall stop the operation of the centre” A cenffe be operated in the State of Haryana only after issuanceof a licence;

(iv) for conversionof aprovisionallicenceinto aregularlicence, the l-icensing authority shall satisfy itself about due compliance of all the conditions of the prcvisional licence by the applicant, fcr which purpose, it may causethe centres to be inspectedby the District Level Committee;

(v) alicenseshallbevalid for aperiodof five ysarsfrom thedate of issue unless suspended,revoked or cancelled by the licensing authority for non compliance of any of the conditions of license and non adherenceto the Minimurn Standardsprescribed under theserules;

(vi) the fee for application for setting up a centre shall be Rs. 10,0001-(tenthousandrupeesonly) for new licence and Rs.5000/-{five thousandrupe€sonly) forrenewal of lieence. The application for renewal of licence shall be made in

the centresestablishedby the Government of Haryana shall be exempted from the paynnentof license fee;

Psychiatric Nursing Hornes/flospitals which are holding licenseundertheMentalHealthAct, 1987(14of 1987land the Central Mental Health Authority Rules 1990) and are providing treatment and care to addicts shall be exempted from applying for the license.They shall be governed under the provisions of Mental Health Act, 1987 (14 of 1987), however, they shall be registered apply fcr registration in Form I to the l,icensinq Authority and supmit data on de- addiction casesin the prescribed performa i.e. Drug Abuse Monitoring System (DAMS) to the Licensing Authority, as directed for the purpose of consolidation of data on de- addiction in the State;

9. (1) The Cenffe shall conforrn to &e following Minirnum Standards; narnely :_

(iv) The centre shall have sufficient ventilation and be free from any pollution which may be detrimental to the health of admitted pafients.

(v) fhe cenffeshallhavepotable/drinkingwaterandrunning waterfor washing,bathingandcleaningpurposes.

(vi) The centre shalt have proper sanitation facilities in terrns of clean and adequatenumber of bathroorns, toilets and sinks.

(vii) Thecentreshallprovidecleanbedlinen,utensilsand articles for personal hygiene of the patients.

(viii) ‘The centre shall provide fresh, nutritious and adequate

(a) reception enquiry / registration counter/waiting space with seating arrangementsfor a minimum of five persons.

(c) space to store records of patients tel ensure confidentiality and a systeniof easyretrieval.

(d) related educational material such as posters to be p{ominently displayedatstrategic points in the cenffes.

(e) pamphlets,,handbills and other educational materials in vernacular shall be made freely available for the public.

B. MEDICAL STANDARDS:_

(i) No patient shall be coerced to undergo detoxification treatment without explaining the range of treatment options available to him including substitution/ maintenancetherapy and psychosocial interventions and his consent for undergoing treatment for de-addiction.

(ii) Treatment protocol of centresshall follow establishedand evidencebasedmedical practice and guidelines published by the Word FlealthOrganization (‘WHO), Government of

10. (1)

, (2) The StateLevel Committee or the l-icencing Authority, as the case may be, may frame guidelinesor impose such conditions as it deemsproper.

(3) Each Centre shall give an undertaking to the effect that it shall protect the human rights of the admitted patients as per the Universal Human Rights and that it will not engagein the following activities with the patientsi.e. solitary confinement,forced labour,punishment,beating,psychologicaltorture, chaining or locking up. The patients liberty shall be protected at all times. It shall allow private interaction with family and provide communication to the patient undersupervisionof theauthorizedpersonof Centre.It will ensureconfidentiality

of medical and counseling records of the patient except caregivers and under judicial orders.

E RECORDMAINTENANCEAFIDDISSEMINATION :-

(i) It shall be mandatory for all the Cenffes to maintain personal and treatment record of all the patients.

(ii) These records shall be confidential and available only to the authorized persons on request with the discretion of Officer in charge of the centre.

(iii) All the data on activities of the centre shall be sent onDrugAbuseMonitoring System(DAMS) Performa developed by the Union Ministry of Health and Family Welfare, tc the Director General Health Services,Haryana and to the Director, Health and
